Please review the provided documents with the assumption that the proposed zone change from CG to MU will be approved. Site C is intended o be a Stand-alone private commercial parking lot shared by all three proposed buildings in conjunction with the on-street parking. A stand-alone private commercial parking lot requires a conditional use permit in the MU Zone per Table 2.3.200. Please confirm that the Owner will be able to restrict access of the lot to commercial tenants and building residents. We believe that it is allowable to over hang the upper floors of the building over the portions of the public sidewalk that is on the Owner's private property and we understand that the Owner will need to record a public access easement for that portion of the public sidewalk that is on private property. Similarly, we are proposing balconies and window sun shades that overhang the sidewalk (in the Arizona ROW) on the north facade and the vacant ROW land to the west, please confirm that this is acceptable. Through correspondence with the Owner, City planner Beth LaFleur has confirmed that the project as proposed meets the definition of vertically mixed Mixed Use. This means that the project will not be subject to the density standards of the RM Zone. It is important to the economic viability of the project to be accurate in this confirmation.
